All offline payments should be made out to Atlanta Luxury<br \/>\nRentals.<br \/>\n<br \/>\n&nbsp;a.&nbsp;&nbsp;&nbsp;Refundable Security Deposit: &nbsp;<br \/>\nThe Security Deposit is due upon the signing of the Lease Agreement.&nbsp;&nbsp;Concurrent with<br \/>\npayment of the Security Deposit the Property Manager and Guest shall conduct a walk-<br \/>\nthrough of the property and Guest shall note any damage.&nbsp;&nbsp;Failure or refusal on the<br \/>\npart of Guest to note such damage shall be deemed acceptance of the Property as<br \/>\n&ldquo;undamaged&rdquo;. The Property Manager will accept Wire Transfer, Company Check,<br \/>\nPersonal Check or Credit Card (with Guest paying an additional merchant fee, if<br \/>\napplicable) as payment. The Security Deposit shall be held in Property Manager&rsquo;s tenant<br \/>\nescrow\/security account held with Chase Bank. The Property Manager will refund the<br \/>\nSecurity Deposit, minus any balances due within 10 business days of check out, by<br \/>\nCheck to the Guest once the property has been inspected by the Property Manager or<br \/>\nthe Property Manager&rsquo;s Representative on a final walk-through wherein Guest is<br \/>\npermitted, but not required, to participate.&nbsp;&nbsp;Any damage to the Property may result in<br \/>\nadditional fees paid by the Guest in addition to loss of the Security Deposit.<br \/>\n&nbsp;&nbsp;<br \/>\n&nbsp;&nbsp;b.&nbsp;&nbsp;&nbsp;&nbsp;Rental Amount:&nbsp; &nbsp;Nightly Rate&nbsp; +&nbsp; State Tax (8.9%):&nbsp; (For Airbnb reservations, you are already paid in<br \/>\nFULL with Airbnb and we are not requesting any additional fees unless it&#39;s a pet fee)&nbsp;<br \/>\nRental Amount is due at time of booking and shall be paid by Wire Transfer, Company<br \/>\nCheck, Certified Funds or Credit Card (with Guest paying the additional merchant fee, if<br \/>\napplicable). The Rental Amount owed includes standard utilities (gas, electric, water,<br \/>\nbasic cable and Wi-Fi) and furnishings. Standard utilities and furnishings shall be<br \/>\ncapped at a maximum on utilities of $600\/month or $20\/day. Any use of utilities in<br \/>\nexcess of the standard amount shall be at an additional charge to the Guest, which<br \/>\nshall be due as additional rent and may be deducted from the Security Deposit.<br \/>\nNo more than two (2) persons unrelated by blood or marriage to any Guest shall be<br \/>\npermitted overnight. If the Guest hosts additional persons overnight at the Property,<br \/>\nthe Property Manager may assess an additional rental fee which amount may be<br \/>\ndeducted from the Security Deposit for the additional persons. Such deduction for<br \/>\nadditional persons will be noted in the written check out inspection.<br \/>\n<br \/>\n&nbsp;&nbsp;&nbsp;&nbsp;c.&nbsp;&nbsp;Exit Cleaning Fee:<br \/>\nThe exit cleaning fee is due at time of booking and shall be paid by the above stated<br \/>\npayment methods as additional rent to the rental amount.&nbsp;&nbsp;If the unit is left in a<br \/>\ncondition such that additional cleaning is necessary exceeding the allotted exit cleaning<br \/>\nfee, the Property Manager may deduct additional cleaning fees from the Security<br \/>\nDeposit for the additional cleaning charges. The Exit Cleaning Fee is non-refundable.<br \/>\n<br \/>\n&nbsp;&nbsp;&nbsp;&nbsp;d.&nbsp;&nbsp;&nbsp;&nbsp;Application Fee (per person):&nbsp;<br \/>\nProperty Manager may require, and Guest consents, to a full application\/background<br \/>\ncheck of anyone staying in the Property. Failure to pass the background check will<br \/>\nresult in forfeiture of the rental amount. The Application Fee is non-refundable.<br \/>\n&nbsp;&nbsp;&nbsp;&nbsp;e.&nbsp;&nbsp;&nbsp;&nbsp;Booking Fee:&nbsp; &nbsp;<br \/>\nBooking fee is in addition to the rental amount, and is required to process the<br \/>\nreservation. The Booking Fee is non-refundable.<br \/>\n&nbsp;&nbsp;&nbsp;&nbsp;f.&nbsp;&nbsp;&nbsp;Non-refundable pet fee\/pet:&nbsp;<br \/>\n&nbsp;&nbsp;&nbsp;Refundable Pet Deposit:&nbsp;&nbsp;<br \/>\nProperty Manager will require a non-refundable and refundable pet deposit per pet. Any<br \/>\ndamage caused by pets above the deposit amount will be taken out of the Security<br \/>\nDeposit. No animals are allowed in the Property without permission of the Property<br \/>\nManager.&nbsp;&nbsp;Damage caused by pets should be reported ASAP to avoid possible<br \/>\npermanent damage (i.e., urine on carpets may be extracted if reported as soon as it<br \/>\nhappens but if left for several days or weeks may cause permanent stains in the carpet<br \/>\nresulting in a costly repair that could have been avoided).<br \/>\n&nbsp;&nbsp;<br \/>\n2.&nbsp;&nbsp;Default: The occurrence of either of the following events or conditions shall<br \/>\nconstitute an &ldquo;Event of Default&rdquo; for purposes of this Agreement:<br \/>\n<br \/>\n&nbsp;&nbsp;a. Noise\/Nuisance: Guest acknowledges that the Property is located in a<br \/>\nresidential building. Pursuant to the City of Atlanta Noise Ordinance, outside noises<br \/>\nshall not exceed 50dB at the property line between the hours of 8 p.m. and 9 a.m., and<br \/>\nshall not exceed 70dB between the hours of 9 a.m. and 8 p.m. Guest shall be<br \/>\nresponsible for the prevention of any noise associated with the occupancy of the<br \/>\nProperty or use thereof exceeding the limits imposed by the City of Atlanta Noise<br \/>\nOrdinance, Section 74-136 or any other ordinance imposed by the City of Atlanta.&nbsp;&nbsp;The<br \/>\nproperty has a noise detection device which is 100% privacy compliant and measures<br \/>\nnoise levels only and does not record any conversations.&nbsp;&nbsp;Tampering with this device is<br \/>\nstrictly prohibited and will result in a $500 fine.&nbsp;&nbsp;Initial noise violations for exceeding the<br \/>\nacceptable dB levels based on time of day will receive a courtesy warning, and the<br \/>\nsecond violation for exceeding the allowable dB will result in a fine of $1,000, and<br \/>\nGuests will be subject to immediate eviction without any refunds.&nbsp;<br \/>\n<br \/>\n&nbsp;&nbsp;b. Smoking: Smoking of any type is strictly prohibited in the property.&nbsp;&nbsp;Each property<br \/>\nhas a smoke detection device which is 100% privacy compliant and only detects<br \/>\nmarijuana and cigarette smoke. Tampering with this device is also strictly prohibited<br \/>\nand will result in a $500 fine.&nbsp;&nbsp;Initial smoking violations will receive a courtesy warning,<br \/>\nand the second violation will result in a fine of $1,000, and Guests will be subject to<br \/>\nimmediate eviction without any refunds.&nbsp;<br \/>\n<br \/>\n&nbsp;&nbsp;c. Parking: Guest acknowledges that Guest of his\/her invitees shall not park anywhere<br \/>\nbut in the designated parking spots assigned to the unit. Guest shall be responsible for<br \/>\nthe acts of any of Guest&rsquo;s invitees with respect to such parking.&nbsp;&nbsp;If Guest is parked in a<br \/>\nparking space other than the space assigned to the unit then he\/she will be asked to<br \/>\nmove the car via text or email.&nbsp;&nbsp;If the car is not moved within 12 hours, Atlanta Luxury<br \/>\nRentals has the option to have the car towed.&nbsp;&nbsp;Multiple violations of the parking rules<br \/>\nwill result in a fine of up to $500, and Guest will be subject to immediate eviction. We<br \/>\nonly provide free parking for the Guest on the lease and not any of Guest&rsquo;s invitees.<br \/>\n<br \/>\n&nbsp;&nbsp;d. Parties: Gatherings of more than four people in studios or one-bedroom units, six or<br \/>\nmore people in two-bedroom units, or more than eight people in four-bedroom units is<br \/>\nnot permitted.&nbsp;&nbsp;Parties or loitering in shared or public spaces is also prohibited.&nbsp;<br \/>\n<br \/>\n&nbsp;&nbsp;e. Filming: No filming of any kind is permitted without written permission prior to your<br \/>\nstay and prior to all fees being processed.&nbsp;<br \/>\n&nbsp;<br \/>\n&nbsp;f. Illegal Activities \/ Drug Use: No illegal activities are permitted anywhere, on or near<br \/>\nthe Premises by the Guest and\/or any of Guest&rsquo;s invitees during the rental period,<br \/>\nincluding drug related illegal activity. &ldquo;Drug-related illegal activity means the illegal<br \/>\nmanufacture, sale, distribution, purchase, use or possession with the intent to<br \/>\nmanufacture, sell, distribute, or use of a controlled substance (as defined in section 102<br \/>\nof the Controlled Substance Act &ndash; U.S.C. 802) or possession of drug paraphernalia.&nbsp;<br \/>\n<br \/>\n3. Travel Protection:&nbsp;&nbsp;As a part of your stay, you may purchase a Vacation Rental<br \/>\nDamage Protection plan designed to cover unintentional damages to the rental unit<br \/>\ninterior that occur during your stay, provided they are disclosed to management prior to<br \/>\ncheck-out. If purchased, the policy will pay a maximum benefit of $3,000. Any damages<br \/>\nthat exceed $3,000 are not covered under the plan will be charged to the credit card on<br \/>\nfile. If, during your stay at one of our rental properties, an insured person causes any<br \/>\ndamage to real or personal property of the unit as a result of inadvertent acts or<br \/>\nomissions, the Insurer will reimburse the Insured for the cost of repair or replacement<br \/>\nof such property up to a maximum benefit of $3,000. Certain terms and conditions<br \/>\napply. Full details of the Vacation Rental Damage coverage are contained in the<br \/>\nDescription of Coverage or Insurance Policy<br \/>\nhttps:\/\/shop.vacationrentalinsurance.com\/ATLANTAL&nbsp;. The Vacation Rental Damage can<br \/>\nbe purchased up to, and including at, check-in. By submitting payment for this plan,<br \/>\nyou authorize and request&nbsp;CSA&nbsp;Travel Protection and Insurance Services to pay directly<br \/>\nAtlanta Luxury Rentals any amount payable under the terms and conditions of the<br \/>\nVacation Rental Damage. Please contact Atlanta Luxury Rentals directly if you do not<br \/>\nwish to participate in this assignment. Guest shall not sublet this lease without the Property Manager&rsquo;s express<br \/>\nwritten consent.<br \/>\n<br \/>\n5. Occupancy. &nbsp;If it is determined that there were more people occupying the unit than allowed, you will be charged $50 per person over<br \/>\nthe maximum guests allowed.<br \/>\n<br \/>\n6. Keys\/KeyCards\/Key Fobs\/Parking Cards:&nbsp;&nbsp;ALL Keys, Cards, Fobs not returned<br \/>\nat the end of the stay will incur a $100-$150 replacement fee per item. Instructions on<br \/>\nwhere to return key\/fobs\/parking passes will be included in the checkout instructions.&nbsp;<br \/>\n<br \/>\n7. Pets Fee: Pets are allowed with an additional $150 pet fee per pet and are subject<br \/>\nto both a refundable and non-refundable pet deposit(s) depending on length of stay.<br \/>\nOnly 2 dogs allowed per unit and only declawed cats unless Property Manager gives<br \/>\nwritten permission.<br \/>\n<br \/>\n8. Cancellations:&nbsp;Guest&#39;s that are staying less than 30 days may cancel their reservation and this rental Agreement during the lease period with a 14 day&nbsp;written notice prior to the original arrival date.&nbsp; Any cancellations within 14 days of arrival are non refundable.&nbsp; If the reservation is Long Term, meaning 30 consecutive days&nbsp;or more, a 30 day written notice must be provided and acknowledged&nbsp;for a full refund before, 30 days of the original arrival date.&nbsp; If cancellation for a Long Term 30 day stay is provided within 30 days of arrival date the penalty will be a 30 day fee.&nbsp;If a Long Term 30 day rental needs to be canceled within the time of the rental agreement, the renter must provide 30 days notice and is responsible for 30 days of rent after notice is given and only after a full 30 days into the Lease.&nbsp; Receipt and acknowledgement of the written notice must be made in order to determine the termination date.<br \/>\n<br \/>\n9. &nbsp;Personal Property and Liability:&nbsp;All personal property kept by the Guest at the<br \/>\nPremises shall be and remain at his\/her sole risk, and Property Manager shall not be<br \/>\nliable for any damages to, or loss of such personal property ensuing from any acts of<br \/>\nnegligence of any party other than the Property Manager, nor from any problems with<br \/>\nthe rental property from any other cause other (other than the gross negligence of the<br \/>\nProperty Manager) whatsoever. Nor shall the Property Manager be liable for any injury<br \/>\nto the Guest or invitees of the Guest in or about the Premises, except an injury which is<br \/>\ndirectly caused by the sole and gross negligence of the Property Manager. The Guest<br \/>\nexpressly agrees to hold the Property Manager harmless in all such cases except for<br \/>\nthose injuries directly caused by the sole and gross negligence or intentional conduct of<br \/>\nthe Property Manager.<br \/>\n<br \/>\n10. Governing Law:&nbsp;This Lease shall be governed pursuant to the laws of the State in<br \/>\nwhich the Premises is located; and invalidation of any portion of this Lease shall not<br \/>\ninvalidate the remainder.<br \/>\n<br \/>\n11. Parking:&nbsp;Guest is to refer to and follow the specific parking rules outlined in the<br \/>\ncheck-in instructions and ALR booklet inside the unit. Atlanta Luxury Rentals shall<br \/>\nnot be liable for towing, booting and\/or ticketing of Guest vehicles. Should<br \/>\nany authorized or unauthorized vehicles be abandoned on the Premises after the lease<br \/>\nperiod concludes, Atlanta Luxury Rentals has the right to have them towed or otherwise<br \/>\nremoved at the Guest&rsquo;s expense.&nbsp;<br \/>\n<br \/>\n12. Parties\/Loitering:&nbsp;The Guest may not host parties at the Premises without prior<br \/>\nwritten permission of the Property Manager. Please refer to Paragraph 2d for limits on<br \/>\nthe number of Guests and invitees permitted at the Premises at any one time. In the<br \/>\nevent that express permission is granted for hosting a gathering that exceeds the<br \/>\nnumber of persons allowed at the Premises at any one time, parking for any such<br \/>\ngathering shall be either in a designated location or remote parking shall be arranged<br \/>\nand a shuttle shall be utilized to access the property. All use of the property shall<br \/>\ncomply with the City of Atlanta&rsquo;s noise ordinance.&nbsp;<br \/>\n<br \/>\n13. Toiletries:&nbsp;Starter toiletries may be provided by the Property Manager for the<br \/>\nGuest as a courtesy, but they will not be re-stocked during the lease term.&nbsp;<br \/>\n<br \/>\n14. Check In\/Check Out Times:&nbsp;Unless otherwise agreed by Property Manager,<br \/>\ncheck in time is 3pm on lease start date.&nbsp;&nbsp;Check out time is 11am on lease end<br \/>\ndate. &nbsp;If you are still occupying the unit after the check-out time, your card<br \/>\non file will automatically be charged the $150 late check out fee.&nbsp;&nbsp;Upon<br \/>\ntermination of this lease, whether by lapse of time or otherwise, Guest shall surrender<br \/>\nthe leased Premises or any part thereof. Also upon termination of this lease, Property<br \/>\nManager may, at its option, treat such retention of possession as constituting a<br \/>\nrenewal of this lease, and so bind Guest, on a day-to-day basis on the same terms and<br \/>\nconditions expressed herein, except that the daily rent shall automatically be increased<br \/>\nto twice the rent in effect for the day immediately preceding the commencement of the<br \/>\nholding over.&nbsp;<br \/>\n<br \/>\n15. Proof of Identity:&nbsp;Guest shall provide a copy of a valid driver&rsquo;s license to Property<br \/>\nManager along with the same credit card used for the reservation. Failure to do will<br \/>\nresult in loss of the rental agreement. The person checking in must be the person on<br \/>\nthe lease agreement. No exceptions.&nbsp;&nbsp;<br \/>\n<br \/>\n16. Event of Default: If the Guest shall fail to pay any rental amount, utilities overage<br \/>\nor other expense as it comes due or if Guest shall be in default in performing any of the<br \/>\nterms or provisions of this Short Term Lease other than the provision requiring the<br \/>\npayment of rent and fails to cure such default immediately, upon notice (oral or written)<br \/>\nfrom Property Manager.<br \/>\n<br \/>\n17. Remedies if Default: Upon the occurrence of any event of default, Property<br \/>\nManager may, except for a default in paying rent which shall not require the notice<br \/>\nprovided for herein, by twenty-four (24) hours prior written notice, at its option, elect to<br \/>\ndo and perform any act required of Guest and charge the cost of performing such<br \/>\naction to Guest as additional rent. In the event Guest fails to pay any sum due<br \/>\nhereunder, Property Manager may require Guest to immediately surrender possession<br \/>\nof the Premises, and if Guest shall fail to do so, Property Manager may immediately<br \/>\ndeclare the license to use Premises terminated and, without further notice and without<br \/>\nprejudice to any other remedy Property Manager may have, enter the Premises and<br \/>\nexpel or remove Guest and Guest&rsquo;s effects, by force if necessary, to the extent<br \/>\npermitted by local law or by judicial decree, without being liable to prosecution or any<br \/>\nclaim for damages thereof; and Guest agrees to indemnify Property Manager for all<br \/>\nlosses, damages, cost and expenses, and reasonable attorney&rsquo;s fees, which Property<br \/>\nManager may suffer or incur by&nbsp;&nbsp;reason of the default of Guest, termination of the<br \/>\nLease, recovery of possession of the Premises, whether through inability to re-let the<br \/>\nPremises and any other concessions granted to Guest, the eviction of the Guest, re-<br \/>\nletting of the Premises, and preparing the Premises for the new Guest or Guests,<br \/>\nincluding, but not limited to, advertising expenses and commissions.<br \/>\n<br \/>\n18. House Rules: This is a non-smoking unit and Guest will be charged a<br \/>\nhefty fine\/liquidated damage of $1,000 if there is evidence of smoking of any<br \/>\nkind. Outside smoking of cigarettes is okay if butts are properly and safely disposed<br \/>\nof.&nbsp;&nbsp;No parties or loitering in shared or public spaces are permitted. No filming of any<br \/>\nkind is permitted without express written permission. No illegal activities are permitted<br \/>\nanywhere, on or near the Premises by the Guest and\/or any occupant, guest or invitee<br \/>\nduring the lease term, including drug-related illegal activity. &ldquo;Drug-related illegal<br \/>\nactivity&rdquo; means the illegal manufacture, sale, distribution, purchase, use or possession<br \/>\nwith intent to manufacture, sell, distribute, or use of a controlled substance (as defined<br \/>\nin Section 102 or the Controlled Substance Act [21 U.S.C. 802]) or possession of drug<br \/>\nparaphernalia. Please be mindful of the neighbors and respectful of the noise<br \/>\nordinance.&nbsp;Again, check in time is after 3pm. Early check in will need to be requested<br \/>\nand approved in writing by the property manager the day before check in.&nbsp;&nbsp;Guests are<br \/>\nnot allowed in the unit if it is being cleaned for the next guest(s) arrival.&nbsp;&nbsp;Check out<br \/>\ntime is by 11am sharp, unless Property management has given written permission for a<br \/>\nlater checkout time.&nbsp;&nbsp;An unapproved late check out will constitute as holdover as<br \/>\ndescribed in item 11 and will be charged as such.&nbsp;&nbsp;<br \/>\n<br \/>\n19. Permission to Enter:&nbsp;&nbsp;Property Manager, or agent acting on behalf of the<br \/>\nproperty manager, may enter rented premises while the tenant is living there without<br \/>\nadvance notice in the case of emergency, such as a fire or serious water leak.&nbsp;&nbsp;&nbsp;The<br \/>\nProperty Manager, or agent acting on behalf of the Property Manager, may enter the<br \/>\nrented premises while the tenant is living there with at least 24 hours advance notice<br \/>\nfor capital improvements, to inspect appliances, change air\/water filters, change parts<br \/>\nof the building or service calls.<br \/>\n<br \/>\n20. Property Entry:&nbsp;In the event that you are locked out and cannot enter your unit,<br \/>\nplease call this 24 hour number at 855-248-0259. This information is also in the check-<br \/>\nin instructions. You will need to verify your name, unit # and email to gain access to<br \/>\nthe unit. We are NOT responsible for reimbursing any unused nights if you do not call<br \/>\nthis number.<br \/>\n<br \/>\n21. Damages:&nbsp;&nbsp;You will be held financially responsible for any and all<br \/>\ndamages and\/or missing inventory during your stay, up to and above your<br \/>\ndeposit. If there is no deposit, you will be charged the full amount of the replacement<br \/>\nitem and any installation fees associated with replacement.&nbsp;&nbsp;A full inventory is done<br \/>\ndirectly before and after your check in. The card on file will be charged for any<br \/>\ndamages outside of the normal wear and tear.&nbsp;<br \/>\n<br \/>\n22. Trash:&nbsp;Any trash violations or property damages billed to The Property Manager<br \/>\nduring the rental period will be billed to the tenant on this lease agreement. This<br \/>\nincludes violations made by the tenant and\/or the tenant&rsquo;s guest(s) and trash violations<br \/>\nare $100\/incident.<br \/>\n<br \/>\n23. Outside Noise \/ Construction Noise: Guest acknowledges that if the Premises<br \/>\nlocated within a mixed-use development that outside noise and\/or construction noise<br \/>\nmay occur, over which Property Manager has no control. Property Manager shall not be<br \/>\nresponsible for or have any liability to Guest for any such outside noise or construction<br \/>\nnoise.<br \/>\n<br \/>\n24. Miscellaneous: Any single violation of the above provisions is a material and<br \/>\nirreparable violation of the lease (regardless of whether or not the Guest has any<br \/>\nknowledge of the violation by an occupant, guest or invitee and regardless of whether<br \/>\nor not the violation occurs on or off the Premises) shall be good cause for immediate<br \/>\ntermination of the lease.
